Australia Terms & Conditions
These Terms and Conditions (“Terms”) apply to all goods and services supplied by Zempire Camping (“the Company”, “we”, “our”, “us”) to the purchaser (“you”, “your”).
By placing an order on our website, you agree to be bound by these Terms as amended from time to time.
1. Payment
All orders must be paid for in full at the time of purchase.
Orders will not be processed until payment clears.
2. Delivery
Delivery times provided are estimates only.
The Company is not liable for delays or losses resulting from delivery delays.
By placing an order, you authorise Zempire Camping and our delivery partners to leave parcels at your delivery address (“Authority to Leave”).
The Company is not responsible for theft or loss after delivery.
Risk in the goods passes to the purchaser when goods leave our warehouse.
Out-of-stock items will be delivered when available.
3. Claims for Transit Damage
You must inspect goods upon delivery.
Damage or shortages noted on arrival must be recorded with the carrier.
Transit damage claims must be submitted within 7 days, with photographs.
If accepted, remedies may include repair, replacement, refund, or credit.
Failure to lodge a claim within 7 days is deemed acceptance.
4. Claims for Shortages or Shipping Errors
Claims for shortages or shipping errors must be made within 7 days.
Accepted claims may be resolved by repair, replacement, refund, or credit.
5. Order Cancellation
Orders cannot be cancelled after checkout unless approved in writing.
The Company may cancel an order for reasons not related to customer fault and provide a full refund.
6. Warranty (Including Mandatory ACL Statement)
Different Zempire product categories include warranties ranging from 1 to 5 years (“Warranty Period”).
Warranty duration is displayed on the website or product documentation.
Goods must be used and maintained in accordance with instructions.
If a warranty claim is accepted, the Company may repair or replace the goods.
Repaired or replaced goods remain covered only for the remainder of the original Warranty Period.
Goods will not be covered if they have been:

misused, abused, or neglected

improperly stored or maintained
-
altered or modified
-
used outside normal recreational or intended purposes
Warranty claims must be submitted via email or online account.
Returned goods must be clean and dry. Risk remains with the purchaser during return transit.
Your Rights Under the Australian Consumer Law (Mandatory Statement)
“Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.”
This warranty is in addition to your rights under the Australian Consumer Law.
7. Liability
Except as required by the ACL, Zempire Camping’s liability is limited to:

the replacement of the goods,

the repair of the goods, or
-
the cost of replacing or repairing the goods.
The Company is not liable for indirect, incidental, or consequential loss unless required by the ACL.
8. Privacy
Personal information is collected, stored, and used in accordance with the Australian Privacy Act 1988 and our Privacy Policy.
9. Errors or Omissions
Clerical or typographical errors may be corrected without liability.
10. Product Descriptions
Product descriptions and imagery may change and are not binding.
11. Force Majeure
The Company is not liable for delays or failure caused by events beyond our reasonable control, including natural disasters, supply chain disruption, labour issues, or government actions.
If such an event continues for more than 6 months, either party may cancel the affected order.
12. Assignment
The Company may assign rights or obligations at any time.
The purchaser may not assign rights without written consent.
13. Intellectual Property
All intellectual property relating to Zempire products remains the property of the Company.
You may not use, copy, or reproduce our IP without written approval.
14. Dispute Resolution
If a dispute arises, the parties must first attempt negotiation.
If unresolved, the matter proceeds to mediation, then arbitration if necessary.
15. Governing Law
These Terms are governed by the laws of Australia and the state or territory in which the purchaser resides.
Both parties submit to the jurisdiction of the courts of that state or territory.
